Terms and Conditions for Online Sales
These terms and conditions (“Terms”) govern the sale of products (“Products”) by L & M Nurseries (“Seller”) to you (“Buyer”) through our website (“Website”). By placing an order for Products on our Website, you agree to be bound by these Terms.
1. Orders
- All orders are subject to acceptance by the Seller. The Seller reserves the right to refuse any order for any reason.
- Once an order is placed, it cannot be cancelled or modified without the Seller’s consent.
2. Pricing and Payment
- All prices for Products are listed in [GB Pounds] and are subject to change without notice.
- Payment for orders must be made in full at the time of purchase through the payment methods accepted on the Website.
- The Seller reserves the right to withhold delivery of Products until payment is received in full.
3. Shipping and Delivery
- Shipping costs and estimated delivery times will be provided to the Buyer during the checkout process. Where plants exceed 1 metre in height or where large volumes of plants are required to be delivered in one order L & M nurseries will request an individual quote for the delivery costs prior to confirming the order.
- Deliveries will be made within 2-3 working days. We will contact you to confirm your delivery date.
- Free Collection –Collections will be available to collect the next day . We will contact you to confirm that your order is ready to collect and agree a collection time. Please remember to bring your confirmation email when you come to collect your order.
- The Seller will make reasonable efforts to deliver the Products to the address provided by the Buyer within the estimated delivery time. However, the Seller is not responsible for delays beyond its control.
- Scottish Highlands & UK Islands -Scottish Highland & Island locations as well as the Isle of Man & Isle of Wight attract a surcharge from our courier, we ask that you contact us to request a delivery cost before placing your order.
4. Returns and Refunds
- To start a return request, please contact us via info@landmlandscapes.co.uk
- In accordance with the UK Distance Selling Regulations, you have 14 days to return an item once you have received it. Please contact us within 14 days of receiving your item to initiate a return.
- Once your return has been accepted, you have an additional 14 days to return the item to us. Please ensure that the item is in its original condition and packaging when you return it.
5. Goods damaged in Transit
- If you receive goods that are damaged, please inspect them carefully upon delivery. If the box is damaged beyond an acceptable state in transit and requires a signature, please sign the delivery as “damaged” and refuse the delivery, also prompt the courier to return it back to us, then, contact us as soon as possible via info@landmlandscapes.co.uk
- We will work with you to resolve the issue and ensure that you receive a replacement or a refund for the damaged goods. Please note that we may require photographic evidence of the damage in order to process your claim.
6. Limitation of Liability
- In no event shall the Seller be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the sale of the Products, including but not limited to loss of profits, loss of revenue, or loss of data.
- The Seller’s total liability for any claim arising out of or in connection with the sale of the Products shall not exceed the purchase price paid by the Buyer for the Products giving rise to the claim.
7. Governing Law
- These Terms shall be governed by and construed in accordance with the laws of England, without regard to its conflict of law provisions.
- Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of England.
8. Amendments
- The Seller reserves the right to amend these Terms at any time without notice. Any amendments will be effective immediately upon posting on the Website.
- It is the Buyer’s responsibility to review these Terms periodically for changes.
By placing an order for Products on our Website, you acknowledge that you have read, understood, and agree to be bound by these Terms.
